A court ruling in South Africa may have set the limits of responsibility placed by regulations on operators, reports Gaming for Africa.
A compulsive gambler lost ZAR5m (€300,000) at Sun City while using his wife’s bank card and also lost his legal bid to sue the operator and the gambling authority.
The gambler opted for self-banning from gambling venues, but still returned and lost the money.
A Johannesburg High Court judge found that he was the author of his own misfortune. He alleged that Sun City knew, or reasonably ought to have known, that by visiting he could suffer financial harm.
His own bank card had been banned from use, but he was able to freely use his wife’s. He claimed that under the gambling regulations the operator should be required to eject the self-banned guest from the premises and Sun was in breach of the obligations.
